These are the terms and conditions on which MacroMed Healthcare Limited, trading as Hayes First Aid, supplies products to you. Please read them carefully before placing an order. 2. Who these terms apply to

These terms apply to all orders placed on our website, by phone or by email, whether you are a consumer or a business customer.

Consumers

A consumer is an individual buying for personal, household or non-commercial purposes. If you are a consumer, you have rights under the Consumer Rights Act 2022, including a 14-day right to cancel an order you placed at a distance, on our website, by phone or by email. These rights are described in Sections 9 and 10 and in our Delivery and returns.

Business customers

If you are buying in the course of a business, trade or profession, you are a business customer. The Consumer Rights Act 2022 applies to consumers. It does not apply to business purchases. As a business buyer, your rights are those given by the sale-of-goods legislation that applies to business-to-business sales, and those set out in these terms.

The 14-day cancellation right does not apply to business purchases. Business customers may return goods otherwise than for fault only at our discretion (Section 9).

You must be aged 18 or over to place an order with us.

3. Your account

Any customer, consumer or business, can open an account on our website free of charge. Your account lets you track orders, view invoices, reorder quickly and manage your details.

Please keep your login details confidential, and tell us at sales@hayesfirstaid.com as soon as you can if you think someone else has used your account.

If an order is placed on your account by someone else without your authority, tell us and we will investigate. You will not be held to that order unless we can show that you deliberately or carelessly allowed it to happen. We do not require you to prove that you kept your login details secure.

We do not offer credit through our website. Every new account pays when it orders. An account that already holds payment terms agreed with us keeps those terms.

4. Products, descriptions and availability

Product information and its limits

Product information is not medical advice

Hayes First Aid does not provide medical advice. The information on our website and in our supporting documents describes products and their technical specification as supplied by the manufacturer. It is not clinical or medical guidance. Always follow the manufacturer's instructions for use supplied with the product.

We take care to make sure that product descriptions, specifications, images and prices on our website are accurate. Product information can change, particularly for medical devices, where manufacturers update their specifications. If information on our website conflicts with the manufacturer's current documentation, the manufacturer's documentation takes precedence for technical specifications.

Product images are representative. Colour, packaging and appearance may vary from the image shown.

Availability

All products are subject to availability. We may withdraw any product from sale at any time. If a product you have ordered is unavailable after your order is placed, we will contact you promptly and offer a full refund, an equivalent alternative or a backorder, at your choice.

Items made to your specification

Some products are made to your specification or clearly personalised, for example a kit assembled to a contents list you supply, or an item printed or engraved to your instruction. If you are a consumer, the 14-day cancellation right does not apply to those items. We tell you before you order when an item falls into this category.

An item that we order in from a supplier for you is not in that category. It is a standard product we do not hold in stock, and your cancellation right applies to it in the normal way.

5. Pricing and VAT

All prices on our website are shown in euro (€). Every price shows two figures: the price excluding VAT and the price including VAT. When you are not signed in, the price excluding VAT is shown first, with the price including VAT beneath it. When you are signed in, your account type sets which figure is shown first.

You can switch between Ex VAT and Inc VAT using the switch at the top of every page. Your choice is remembered: on your account when you are signed in, and in your browser when you are not. The price including VAT is always shown, whichever figure is shown first.

The VAT rate that applies to each product is shown with its price. VAT is shown as a separate line in your basket, at checkout and on your invoice.

If a pricing error occurs on our website or in a quotation, we are not obliged to supply goods at the incorrect price. We will tell you as soon as reasonably possible and give you the choice to proceed at the correct price, accept an alternative, or cancel your order with a full refund.

Where your account carries its own pricing, you see those prices when you are signed in. Account pricing is confidential to that account and is not for redistribution.

6. How to order and when a contract is formed

You can place an order on our website, by phone on 069 66006 or 01 5079900, or by email at sales@hayesfirstaid.com.

When you place an order on our website, you will receive an order acknowledgement by email. The acknowledgement confirms that we have received your order. It is not acceptance of your order. A binding contract between you and Hayes First Aid is formed when we dispatch the goods and send you a dispatch confirmation email, or when we confirm acceptance of your order in writing.

We may decline any order, including where goods are unavailable, a pricing error has occurred, or we are unable to verify your payment.

For phone and email orders, a contract is formed when we confirm acceptance verbally or in writing.

Our standard service is next working day delivery to all 32 counties, using DPD. Order before 12pm Mon–Fri for same-day dispatch. Same-day dispatch applies to items in stock. We are closed at weekends and on Irish public holidays.

“Everybody” includes consumers, schools, clubs, community groups and businesses, whether or not they hold an account with us. Opening an account or signing in does not change the free-delivery threshold that applies to you.

You can also collect your order from us in Newcastle West using Click & Collect.

We do not take orders for delivery to Great Britain.

See our Delivery and returns for full details.

Delivery timescales are estimates. We are not liable for delays caused by circumstances outside our control, including carrier delays, adverse weather or events of force majeure. If you are a consumer, this does not affect your right to a remedy where delivery is late.

Risk in the goods passes to you on delivery. Title (ownership) passes to you on receipt of full payment.

If you are a consumer, the 14-day cancellation period begins the day after you receive the goods. Where an order is delivered in separate lots, it begins the day after you receive the last item.

9. Returns and cancellation

Our full returns and refund policy is set out in our Delivery and returns, including a model cancellation form you may use if you want to. The main points are summarised below.

Consumer right to cancel (orders placed at a distance)

If you are a consumer buying at a distance, on our website, by phone or by email, you may cancel within 14 calendar days of the day after delivery, without giving any reason. Where an order arrives in separate lots, the 14 days run from the day after you receive the last item. You may also cancel at any time before dispatch.

Tell us in any clear way: by email, by phone, by letter, or by using the model cancellation form in our Delivery and returns. A return number helps us process your return faster, but it is not a condition of cancelling.

Return the goods within 14 days of telling us. You may handle and inspect the goods as you would in a shop. If you have handled them beyond what is needed to check their nature, characteristics and functioning, we may deduct an amount for the reduction in their value. We will tell you the amount and the reason before we process your refund. We will not refuse the cancellation.

We refund the price of the goods and the standard delivery cost within 14 days of the day you tell us you are cancelling. We may hold the refund until the goods are back with us or until you send us proof of postage, whichever happens first. Return postage for change-of-mind cancellations is at your cost.

Items the cancellation right does not cover

  • Goods sealed for health-protection or hygiene reasons, where the seal has been broken after delivery, for example sterile wound-care items, eyewash solutions, single-use PPE, AED electrode pads, CPR face masks and resuscitation barriers.
  • Goods made to your specification or clearly personalised.
  • An AED that has been used on a person.

Full detail, and the position for faulty goods, is in our Delivery and returns.

Business customers

The statutory right to cancel applies to consumers, not to business purchases. Returns by business customers are at our discretion. A handling fee may apply, as set out in our Delivery and returns page. A return number is required for business returns.

How to start a return

Contact us at sales@hayesfirstaid.com or on 069 66006.

10. Faulty goods and your legal rights

If you are a consumer, the Consumer Rights Act 2022 requires goods to be of the quality, description and fitness for purpose you are entitled to expect. If goods do not meet that standard, your statutory rights apply regardless of any other term in this agreement.

Within 30 days of deliveryYou can reject faulty goods and receive a full refund. We cover all return costs.
After 30 daysYou choose between repair and replacement. We will carry out your choice free of charge and within a reasonable time. Where the remedy you choose is impossible, or disproportionate compared with the other one, we will tell you why and offer the alternative. Where neither can be provided within a reasonable time or without significant inconvenience to you, you can have a price reduction or a refund.
The first yearIf a fault appears within one year of delivery, it is presumed to have been there at delivery unless we can show otherwise. You do not have to prove it.
Up to 6 yearsIrish law allows you to bring a legal claim for a faulty product for up to six years from the date of delivery.

These rights are consumer rights. If you are a business customer, your rights for faulty or incorrectly supplied goods are those given by the sale-of-goods legislation applying to business-to-business sales and by these terms, not by the Consumer Rights Act 2022.

For damage in transit, please tell us, with photographs, within 48 hours of delivery so we can raise a claim with the carrier. This 48-hour window is an operational requirement for carrier claims and does not limit your statutory rights.

11. Medical device information: AEDs and defibrillators

Automated external defibrillators (AEDs) sold by Hayes First Aid are CE marked under the EU Medical Devices Regulation (EU) 2017/745. AEDs are generally Class IIb devices. The classification that applies to a specific model is stated on that product's page. Check there rather than relying on the general position.

Accessories are not covered by that statement. An accessory is classified in its own right under the Regulation, and its class can differ from the class of the AED it is used with. An AED cabinet is not a medical device.

MacroMed Healthcare Limited is registered with the Health Products Regulatory Authority (HPRA) as a distributor of medical devices. That registration is an economic-operator registration and is not specific to any device class. It is not an HPRA accreditation, approval or endorsement.

Please read before buying an AED

AEDs are for use on a person in sudden cardiac arrest. An AED analyses the heart rhythm and, where the rhythm is shockable, delivers a shock. Modern AEDs guide the user with voice and visual prompts, but we strongly recommend that everyone who may use the device completes first aid and CPR/AED training.

Hayes First Aid does not provide medical advice. Product information on our website and in our supporting documents describes the technical specification of devices as supplied by manufacturers. It is not clinical or medical guidance. Always follow the manufacturer's instructions for use supplied with the device.

In an emergency, call 112/999.

Manufacturer warranties, consumable replacement schedules and device-specific guidance vary by model. Refer to the product page and the manufacturer's documentation for your device. Electrode pads and batteries must be replaced on the manufacturer's schedule to keep the device ready for use. We are not responsible for a device failing because its consumables were out of date or were not fitted as the manufacturer directs. Nothing in this paragraph affects your rights if the device or its consumables were faulty when supplied.

The Unique Device Identifier (UDI) label on an AED must not be removed, covered or obscured.

Registering your AED with the National Ambulance Service

Registration places your AED on the national AED register, so that ambulance control can direct a 112/999 caller to it. We encourage every purchaser to register their device. You register directly. We do not register AEDs on your behalf. Details are on our register your AED page.

12. WEEE and waste batteries: take-back

Electrical equipment and waste batteries are handled under separate rules.

Electrical equipment (WEEE): one-for-one, like-for-like

AEDs and other electrical equipment are covered by Ireland's Waste Electrical and Electronic Equipment (WEEE) regulations. Hayes First Aid is registered for WEEE retailer take-back (registration number 20208) and operates one-for-one, like-for-like take-back: when you buy a replacement item from us, we take your old equivalent item back for recycling, free of charge.

Waste batteries: free, no purchase required

We take back waste batteries free of charge whether or not you buy anything from us. There is no one-for-one condition and no purchase condition. Bring or send us your waste batteries, including AED batteries, and we will have them recycled.

To arrange take-back of end-of-life equipment or waste batteries, contact us on 069 66006 or at sales@hayesfirstaid.com.

13. Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by Irish law.

Subject to the above, and to the fullest extent permitted by law:

  • We are not liable for any indirect, consequential or economic loss, including loss of profit, revenue, data or business opportunity.
  • Our total liability to you in connection with any order shall not exceed the price paid for the goods in that order.
  • We are not liable for delays or failures caused by events outside our reasonable control, including carrier delays, supply chain disruption or force majeure events.

If you are a consumer, these limitations do not affect your statutory rights, and any term that would reduce them does not apply to you.

14. Intellectual property

All content on our website, including text, images, product descriptions, logos and design, is the property of MacroMed Healthcare Limited or its content suppliers and is protected by Irish and EU copyright law. You may not copy, reproduce or use our content without our prior written permission.

15. Privacy and data protection

MacroMed Healthcare Limited is a data controller under the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988–2018. We collect and use your personal data to process your orders, manage your account, communicate with you and meet our legal obligations.

Our payment provider is Stripe, which processes payment data securely. We do not store card details.

We use DPD as our delivery partner. Your name, delivery address and phone number are shared with DPD solely for the purpose of delivering your order.

16. Complaints, governing law and disputes

Complaints

If something has gone wrong, please contact us first at sales@hayesfirstaid.com or on 069 66006. We will acknowledge your complaint within 2 Working Days and give you a full response within 10 Working Days. If we need longer, we will tell you why and when to expect an answer.

Governing law

These terms and any contract formed between you and Hayes First Aid are governed by the law of Ireland.

If you are a consumer, you keep the protection of the mandatory consumer law of the country in which you live, and you may bring proceedings in the courts of that country as well as in Ireland. Nothing in these terms restricts where you may bring a claim.

If you are a business customer, the courts of Ireland have exclusive jurisdiction.

If we cannot resolve it between us

  • You can use an alternative dispute resolution (ADR) body authorised in Ireland. The list of authorised bodies is published by the Competition and Consumer Protection Commission (CCPC).
  • You can use the Small Claims procedure for consumer claims up to €2,000.
  • If you are a consumer in another EU country, Iceland or Norway, the European Consumer Centre Ireland gives free advice, and the European Small Claims Procedure is available.

17. Changes to these terms

We may update these terms to reflect changes in our business, in the law or in the way we work. The last-updated date on this page shows which version is current.

We will give you at least 30 days' notice of any material change, and we will say plainly what has changed and why. If you do not want to accept a change, you may cancel any affected order before the change takes effect, at no cost to you, and we will refund you in full.

The terms that apply to an order are the terms in force when that order was accepted. A later change does not apply to a contract already formed.
